Experience:
Alan D. Mandl has over 30 years’ experience representing corporate, governmental and consumer interests in energy, telecommunications and cable matters. He is AV-rated. Mr. Mandl is a former Assistant Attorney General and Chief of the Utilities Division with the Massachusetts Office of the Attorney General, where he represented consumer interests in gas, electric and telecommunications rate cases, financing dockets and other proceedings. He has represented municipal and investor-owned utilities, a regional cable trade association and individual cable operators, public authorities, colleges and municipalities in a wide range of regulatory, transactional and advisory matters. He has assisted clients regarding the permitting of energy and telecommunications facilities. Mr. Mandl has served as a mediator and is trained as a mediator in accordance with Massachusetts General Laws, Chapter 233, Section 23C. Mr. Mandl has worked collaboratively with client in-house counsel and national counsel.
Mr. Mandl provides strategic counseling and has enabled clients to satisfy their interests at a reasonable cost. He is an effective advocate, able to work constructively with or on behalf of corporate, governmental and individual stakeholders.
Examples of Mr. Mandl’s work include:
- Representation of municipality regarding off-shore wind project PPA in regulatory proceeding
- Advice to clients regarding the Massachusetts Green Communities Act and related regulations, including net metering and renewable portfolio standards
- Negotiation of energy management services (“ESCO”) agreement covering up to 80 buildings over three phases and involving a cogeneration component
- Representation of a public authority in connection with electric sales from customer-owned generation, development of gas and wholesale electric power procurements, negotiation of power purchase and interconnection agreements
- Representation of municipal utilities regarding regulatory, transactional and general matters, including power supply procurements
- On brief as an Assistant Attorney General in multi-state litigation involving a state tax on gas transported from the Outer Continental Shelf, Maryland v. Louisiana, 451 U.S. 725 (1981).
- Lead counsel as Assistant Attorney General in utility rate cases involving revenue requirements, affiliate transactions, cost allocation, rate design and prudence issues, and in financing approval and other regulatory matters
- Representation of investor-owned utilities, CLECs, state agencies and authorities, and consumer interests in gas, electric, ferry and telecommunications rate proceedings and related matters
- Representation of competitive local exchange carriers in market entry, ILEC rate cases, interconnection agreement negotiation and arbitration, municipal permitting of poles, conduit and fiber, disputes with pole owners, and access to mass transit rights of way
- Representation of CMRS providers in siting towers
- Representation of cable television operators and regional cable trade association in pole attachment rate and other disputes, rate regulation matters, franchise renewal, municipal and private overbuilds, and numerous rulemaking and adjudicatory matters
- Advice to clients regarding public bidding and telecommunications taxation issues
- Representation of municipality in preparation of turnkey intra-municipal fiber network construction and maintenance agreement and on related regulatory issues
- Drafting and negotiation of point to point communications service agreements
- Retained as mediator to assist in negotiation regarding a dispute involving electric utility, waste to energy generator, waste disposal district, Consumer Advocate, individual ratepayer and environmental stakeholders
Mr. Mandl has previously chaired or participated on Massachusetts Continuing Legal Education panels and has spoken before the Massachusetts Telecommunications Council, the New England Cable and Telecommunications Association, Inc., Massachusetts Municipal Association and Chambers of Commerce on telecommunications and energy issues. He has published articles on utility ratemaking and telecommunications topics. Recently, he contributed two articles on broadband deployment issues to StimulatingBroadband.com.
Mr. Mandl is a member of the Energy Bar Association, Northeast Energy and Commerce Association, Federal Communications Bar Association, New England Chapter –Association for Conflict Resolution and the Rhode Island Mediators Association.
Mr. Mandl served in the Connecticut National Guard and the United States Army Reserve. His interests include history, family genealogical research, community issues, writing and sports.
