Smith & Duggan's appellate practice group prosecutes and defends appeals in civil cases in state and federal courts. We have successfully handled numerous appeals before the Massachusetts Supreme Judicial Court and Appeals Court and the United States Court of Appeals for the First Circuit; three of us have briefed and argued cases before the Supreme Court of the United States. The firm has particular in-depth experience in the appeal of final decisions of government agencies, constitutional law issues, and product liability cases, as well as with single justice practice unique to Massachusetts.
Smith & Duggan's appellate practice group is headed by H. Reed Witherby who has briefed and argued dozens of appeals before the Massachusetts and federal appellate courts, including the United States Supreme Court. Mr. Witherby is a member of the bar of the Massachusetts Supreme Judicial Court, the United States Courts of Appeals for the First, Second, Sixth, and Eleventh Circuits, and the United States Supreme Court. Mr. Witherby is currently focusing upon constitutional law, administrative law, and voting rights matters.
